What is Mediation?
When two or more parties are in conflict, mediation can help these parties reach a settlement or agreement. With a mediator there, it can make reaching an agreement that fits both party’s needs much simpler and faster.
There are several advantages when it comes to mediation. One of the most important advantages is choice. Mediation allows the choice to be yours and not left up to a judge, arbitrator or jury. The agreement will be on your terms and conditions. Mediation also focuses on needs, interests, and feelings. This form of alternative dispute resolution (ADR) allows both parties to not only tell their side of the story, but it also treats the situation as a problem that has underlying issues that need to be solved. Not only can mediation save you time, it can also save you some money. Mediation is faster than going to court and in most cases, cheaper.
Is Mediation Right For You?
Mediation can assist in almost any type of case or dispute. Whether the dispute is over a business transaction, a property dispute, constructions issues, or a car accident, mediation can help the parties worked toward a solution to the dispute.
You can see how these examples of cases could benefit from making an agreement that best works for both parties. When a judge, arbitrator, or jury is making the decision, leaving it up to chance could benefit one party while the other party is left with needs unsatisfied. For example, in a truck accident case, there will be a winner and a loser if it goes to court. Either the injured party will be compensated, or the trucking company will win. At mediation, all of the issues can be discussed with a third party, and that party can objectively speak with both sides to try and bring them together and settle the claim without leaving it up to twelve people who have never met either side.
